Hire Terms Condition
The‘Company’ is Elveys-Canoe.co.uk. The ’Hirer’ is any person/s or company who hires or has agreed to hire equipment from Elveys-Canoe. co.uk. ‘Equipment’ means items provided by the Company detailed on the“Hire Agreement”, upon the terms and conditions set out in the agreement
Before Hire
1) All adult participants should sign the hire agreement before hire commences. A responsible adult will need to sign for anyone under the age of 18.
2) By signing the hire agreement each named participant is confirming the following:
Agreement with the terms and conditions of Elveys-Canoe.co.uk
Disclosure of any relevant medical information
Acknowledgement of risk involved in canoeing and kayaking
Relevant safety information has been provided
3) Hirers booking by telephone or email will be deemed to have read and accepted these terms and conditions.
Booking and payment
4) A discretionary booking deposit may be required to secure a booking. Any deposit required will be clearly stated on the booking form.
5) A booking is not confirmed until the booking form has been completed and returned and any applicable booking deposit has been received.
6) Total cost of hire must be paid in full before boats and equipment are released.
7) A security deposit may be required before hire commences. Any security deposit required will be clearly stated on the booking form. Any security deposit will be returned at the end of the hire period on return of all hired equipment subject to this being in the same condition and no damage has occurred (allowing for fair wear and tear).
Cancellation
8) In the event of cancellation by the hirer we will refund any payment made as long as we receive 24 hours notice of cancellation.
9) Hire is subject to safe river levels /flows and weather conditions. If a cancellation is deemed necessary for safety reasons, we will provide as much notice as possible and try to offer an alternative date. If no alternative date can be offered/agreed we will refund any payment received. Elveys-Canoe.co.uk cannot allow customers to paddle when Environment Agency red strong stream warnings are in place on the river.
Disclaimer/Acceptance of Risk
10) Elveys-Canoe will not be liable for any death, personal injury, or loss of or damage to goods arising out of the hire of any items by them unless that death, personal injury or loss of, or damage to the goods arises directly from an act of omission on the part of the company, its servant or agent.
11) Canoeing and/or kayaking are inherently dangerous activities with a danger of personal injury or death attached. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement. By accepting these Terms and Conditions you are confirming that you are aware of this and accept the risks associated with this activity
Care of Equipment
12) The hirer assumes complete responsibility for any loss or damage to equipment during the period of hire and agrees to pay for any loss or damage of equipment (allowing for fair wear and tear)
13) The hirer will ensure that all hired equipment is kept in their possession throughout the hire period and is not left unattended at any time.
14) The hirer agrees not to sell, sublet or dispose of any items of hired equipment
15) The hirer will allow access to equipment at any reasonable time by company representatives for the purpose of inspection, repair or removal.
16) Where hirer is transporting canoes/kayaks they must have adequate means of strapping/securing boats on vehicles/trailers. Elveys-Canoe reserves the right to refuse hire if they deem this not to be the case.
17) The company confirms that all equipment hired will be fit for purpose and in full working order
General
18) Anyone under the age of 18 must be accompanied by an adult on their trip
19) Children should be aged 6 or over unless parents have specific water based experience
20) All participants must wear a buoyancy aid at all times whilst on the river
21) A minimum of 2 people must paddle a canoe unless the hirer has previous experience paddling solo in which case please contact us to discuss
22) It is advised that all participants are proficient swimmers
23) Canoe Hire is restricted to the River Medway between Tonbridge and Allington (The River Medway Canoe Trail)
24) Dogs are welcome in our canoes although buoyancy aids will not be provided and they should not be tied onto the boats
25) Participants must be considerate to all other river users (fellow canoeists, powered boats and fisherman)
26) Participants are responsible for ensuring they have the correct clothing, and are fit enough to complete any trip undertaken
27) Only land at suitable areas and designated landing stages/picnic areas
28) Consumption of alcohol in boats is not permitted at any time. Alcohol can be carried for consumption off the water (overnight camps etc)
29) Anyone who appears under the influence of drink or drugs will not be allowed to hire and will not be eligible for a refund
30) Fishing is subject to the appropriate licences and permissions
31) The designated responsible adult must show Photo-ID, in the form of either a passport or driving license on the day of hire
32) Elveys-Canoe does not have any responsibility whatsoever for loss or damage to your personal belongings. You should be aware that any water resistant containers supplied by us cannot be guaranteed to be water proof. You should not rely on the water resistant containers that we supply to keep your property dry, and you accept that you are taking your personal property on to the river at your own risk
33) People with existing injuries should not participate if the nature of the injury will affect their ability to take part in the activity
34) Hirer is responsible for arranging and paying own parking and travel arrangements.
35) We reserve the right to make amendments to these Terms and Conditions without notice.
